Who we are

This website, digiiq.com, is run jointly by Digiiq Inc, 1401 21st St Ste 4844, Sacramento, California 95811, United States, and Digiiq IT Solution Pvt Ltd, Smart World World Trade Tower, Noida, Uttar Pradesh, India (together, “DigiIQ”, “we”, “us”).

For the personal information described in this policy, DigiIQ is the controller under the EU and UK GDPR, the business under California law, and the data fiduciary under India’s Digital Personal Data Protection Act, 2023. You can reach us about anything in this policy at info@digiiq.com.

What this policy covers

This policy covers personal information we collect through this website: when you browse it, fill in one of our forms, talk to our chat assistant or sign up for our newsletter.

It does not cover information we process for our clients when we deliver a project. That work is governed by our contract with each client, and the client decides how that information is used.

Information you give us

• Demo and project requests: your name, work email and company, the area your project is in, its timeline and budget range, and your message.
• Job applications: the role you apply for, your name, email and phone number, your resume and any note you add. Please leave sensitive details, such as health or religious information, out of your resume.
• Newsletter: your email address.
• Chat assistant:the messages you type and the assistant’s replies, so it can answer you and keep the conversation going.
• Emails you send us: your address and whatever you choose to write.

Information collected automatically

• Your cookie choices: a random identifier, the choices you made, whether your browser sent a Global Privacy Control signal, and the date.
• Usage data, only if you allow analytics: pages viewed, clicks, scrolling, how you arrived, your device and browser, and an approximate location derived from your IP address.
• Error reports: technical details of a page or server error. We set these up to leave out cookies, form contents, IP addresses and anything typed into a web address.

We do not buy personal information or collect it about you from other sources, and we do not ask for sensitive personal information.

How we use it and why

We use your information only for the purpose you gave it to us for:

• Answering demo and project requests: to reply and discuss a possible engagement. Legal basis: taking steps at your request before a contract, and our legitimate interest in responding to business enquiries.
• Recruiting: to assess your application and contact you about it. Legal basis: taking steps at your request before a possible employment contract.
• Sending the newsletter: Legal basis: your consent, which you can withdraw with the unsubscribe link in every email.
• Running the chat assistant: to answer your questions. Legal basis: our legitimate interest in helping visitors find what they need.
• Analytics: to understand which pages are useful and improve the site. Legal basis: your consent, given in our cookie settings.
• Keeping the site working and secure: error reports and necessary cookies. Legal basis: our legitimate interest in a working, secure website.
• Keeping a record of your cookie choices: Legal basis: our legal obligation to show that consent was given.

For visitors in India, we process your information on the basis of your consent, or for the legitimate uses the Digital Personal Data Protection Act allows, such as the purpose for which you voluntarily gave it to us. We do not use your information for automated decisions that have legal or similarly significant effects on you.

Cookies and similar technologies

Cookies are small files a website stores in your browser. These are the ones we use, and nothing is sent to an analytics provider until you allow it:

• Necessary, always on: Keep the site, the chat assistant and the admin working. Set by DigiIQ and our chat assistant.
• Analytics, only if you allow them: Show us which pages are useful and how people move through the site, so we can improve it. Set by Google Analytics and Microsoft Clarity.

If your browser sends a Global Privacy Control signal, we treat it as a refusal of any advertising cookies. You can change or withdraw your choice at any time, and withdrawing removes our analytics cookies from your browser. Cookie settings

Who we share it with

We do not sell your personal information, and we do not share it for advertising. We share it only with:

• Each other: Digiiq Inc and Digiiq IT Solution Pvt Ltd, so the right team can respond.
• Service providers who work for us, under contracts that let them use your information only to provide their service: Google Cloud (hosting and file storage), Amazon Web Services (sending email), Google Analytics and Microsoft Clarity (analytics, only with your consent) and Sentry (error reports).
• Salesforce, where a client engagement involves it.
• Authorities or advisers, when the law requires it or to protect our rights.
• A buyer or successor, if our business is reorganised or sold, subject to this policy.

International transfers

We work from the United States and India, and our service providers process information in the United States and elsewhere. So your information may be handled outside the country you live in. Where the law requires it, for example for transfers out of the European Economic Area or the United Kingdom, we rely on safeguards such as the European Commission’s Standard Contractual Clauses in our providers’ data processing terms.

How long we keep it

We keep personal information only as long as we need it for its purpose:

• Demo and project requests: while we discuss the enquiry and any engagement that follows.
• Job applications: for as long as we need to complete hiring for the role and answer any questions about it.
• Newsletter: until you unsubscribe.
• Analytics cookies: up to two years in your browser, or until you withdraw consent or clear them.
• Records of your cookie choices: for as long as we need to show that consent was given.

We may keep information longer where the law requires it, or to establish or defend a legal claim. You can ask us to delete your information at any time.

How we protect it

We use technical and organisational measures to protect your information. Resumes are stored privately and only authorised members of our team can open them. No system is perfectly secure, but if a breach affects you, we will tell you and the relevant authorities as the law requires.

Your rights

Wherever you live, you can ask us to access, correct or delete the personal information we hold about you, and you can withdraw any consent you gave. Depending on where you live, you may have further rights, set out below.

To use any of these rights, email info@digiiq.com. We may need to confirm your identity first. We reply within one month, or sooner where local law sets a shorter time. Using your rights is free, and we will not treat you differently for doing so.

In the European Economic Area and the United Kingdom

You can also ask us to restrict how we use your information, object to processing based on our legitimate interests, and receive your information in a portable format. You can complain to the data protection authority where you live or work.

In California and other US states

In the last 12 months we collected the categories of information listed above: identifiers and contact details, professional and employment information from job applications, the content of your messages, and internet activity if you allow analytics. We collected it from you, for the purposes in How we use it and why.

You have the right to know what we collect and how we use it, and to correct or delete it. We do not sell personal information or share it for cross-context behavioural advertising, and we do not use sensitive personal information, so there is nothing to opt out of. We still honour Global Privacy Control signals. You can use an authorised agent to make a request for you.

In India

Under the Digital Personal Data Protection Act, 2023, you can ask for a summary of the personal data we process and who we have shared it with, have it corrected, completed, updated or erased, and nominate someone to use your rights if you die or become incapacitated. If you are not satisfied with how we handle a grievance, you can complain to the Data Protection Board of India.

Children's privacy

This website is for a business audience and is not directed at children. We do not knowingly collect personal information from anyone under 18. If you believe a child has given us information, contact us and we will delete it.

Other websites

Our site links to websites we do not run, such as our social media pages. Their own privacy policies apply when you visit them.

Changes to this policy

We review this policy at least once a year and update it when our practices change. The date at the top of this page shows the latest version. If a change affects how we use information you have already given us, we will ask for your consent where the law requires it.
